|摘要:||Rural regeneration regulations have been legislated on August 4, 2010. The goals of these regulations are promoting the sustainable development and active regeneration of rural. The content of regulations includes improvement of basic production conditions, maintenance of rural ecology and culture, enhancement the quality of life, value-added development of leisure agriculture and rural tourism, and increase of new rural wealthy. Although rural regeneration has been conducted nearly four years, the hardware facilities and basic productions condition have been upgraded, but rural regeneration regulation did not mention the relative provision about the construction of public facilities in rural areas which need use private land. To enable the relevant public facilities in rural regeneration facility can legally construct on private land, it is necessary to get the land use consents from ownership. Moreover, the law property or validity of the land use consents did not illustrate in rural regeneration and no further explanation of how its effectiveness. Therefore, this research will discuss the implementation of public facilities in rural regeneration relevant laws. Some regulations, such as use allowance, land acquisition, land use consents, and the standard of legal building are suggested to be modified. We hope the research results can be used as a reference of executing the public facilities in rural regeneration.|
